These terms apply to your use of the Naily app. By creating an account, you agree to them. We wrote them as plainly as we could; read them together with our privacy policy.
About Naily
Naily is an app to keep track of your nail designs, your polishes and your stash, and to share them with friends. The app is offered by SmoothIT BV, Wagenbruggelaan 44, 8200 Brugge, company number BE1033190748 (“we”).
Your account
You create an account by signing in with Apple or Google. You must be 13 or older to use Naily.
You are responsible for what happens with your account. If you think someone else has access to it, let us know right away at [email protected].
What you add stays yours
Your photos, notes and other content remain yours. You only give us the right to store, process and show them as far as needed for Naily to work: showing them to you, recognising colours and labels, and showing them to the friends you share them with. That right ends when you delete the content or your account.
Only add photos you took yourself or have permission to use. If someone else is recognisable in a photo, ask them first.
Friends
With your friend ID, others can add you as a friend. Friendship works both ways: friends see each other’s shared designs. You decide what to share for each design, and you can always remove a friend again.
Only give your friend ID to people who may see your designs.
What is not allowed
Do not use Naily to:
- share content that is unlawful, offensive, sexually explicit or discriminatory;
- harass others or violate their rights, such as their privacy or their copyright;
- misuse, overload, copy or automatically scrape the app or our servers;
- pretend to be someone else.
If you break these rules, we may remove content and suspend or close your account. Where possible, we tell you why first.
If you see something that is not okay, report it in the app. You can also block someone. We look at every report as soon as we can.
Automatic recognition
Naily automatically recognises colours in your photos and reads the labels on bottles. This usually works well, but not always: check what the app suggests and adjust it where needed.
The service
Naily is currently free. We keep improving the app and may add, change or remove features. We do our best to keep Naily available at all times, but we cannot promise it will always work without interruption.
If we ever add paid features, we will say so clearly in advance, and you never pay unless you choose to.
Stopping
You can stop at any time by deleting your account in the app, under Settings. We then erase your data as described in the privacy policy. If we ever stop Naily, we will tell you well in advance so you can download your photos.
Liability
We build Naily with care, but the app is provided as it is. As far as the law allows, we are not liable for indirect damage, such as lost data or missed opportunities. So keep your own copy of photos that matter to you.
Nothing in these terms limits your rights as a consumer, or our liability for intent and gross negligence.
Applicable law
These terms are governed by Belgian law. If there is a dispute, we first look for a solution together; if that does not work, the courts designated by law are competent. As a consumer, you keep the protection of the law of the country where you live.
Changes
We may update these terms. If it is something important, we let you know in the app beforehand. If you keep using Naily afterwards, the new terms apply.
